In 2004, the Individuals with Disabilities Education Act (IDEA) was born, and dressed up in a pretty package [think Trojan horse], to make sure that children with disabilities were given a fair shot at the best education they could get…
You may have heard of IDEA and its “partner in crime” Title 1 in our articles on Common Core and Data Collection.
But with IDEA came “Child Find”, something that would make the Gestapo of Nazi Germany proud.
Child Find was first brought to Wyoming Freedom in Education’s attention yesterday, when one of our members sent us this Newspaper clipping from the August 20th, 2015 Dubois Frontier.
When I first read that, a history lesson came to mind:
“Which of your neighbors are Jewish?”,
“Which of your neighbors are harboring Jews?”

ATTENTION PARENTS and COMMUNITY MEMBERS
Fremont County School District #2 has devised a comprehensive “Child Find” Plan. This plan incorporates the following Child Find activities so as to provide resources to ensure an appropriate education for all children ages 3-21 with Fremont County School District #2.
The District shall survey enrolled students pertaining to their knowledge of any other children who are not attending school at this time.
Our District’s counselor shall track and follow up on all FCSD#2 previous year “drop out” students, in effort to urge that they return to or attend a school to receive an appropriate education.
The District will run advertisements in the local newspaper(s) urging any patrons who are aware of any child/children that are not presently enrolled in or attending a school or receiving and adequate and appropriate education to please notify this District.
These “Child Find” notices will also be mailed to all parents, agencies, businesses and home schools in our community/district.
Therefore, Fremont County School District #2 urges any students, parents or community members who are aware of an child/children that are not receiving an adequate and appropriate education to please notify the district at 307-455-5545. Thank you.
I just want to know who gets to determine what an “adequate” and “appropriate” education is. This is bad news for parents who do not send their children to preschool, this is even worse news for homeschoolers.
***This is where I need to make very clear that the compulsory age in Wyoming is 7-16 Read the State Homeschool Statutes here. Also, the state law already requires that parents of children of compulsory age turn in a letter of intent/curriculum submission every year… So FCSD#2 knows exactly who the homeschoolers are and what curriculum they are using, it, quite frankly, is none of their neighbors’ business. ***
I have a story of a situation that happened in Casper a couple of years ago, to share with you about the dangers of “busy bodies”.
Those that would love to offer up their less-than-reliable gossip to kiss up to anyone in “power”. Those that would pounce like a starving cheetah after reading a notice like the one from Fremont County School District #2 in the Dubois Frontier.
But first, let’s get down to the bottom of Child Find…
IDEA is supposed to for children with disabilities, and the ad in the Dubois Frontier doesn’t say anything about that… So what exactly is Child Find?
Wright’s Law says:
“The Individuals with Disabilities Education Act includes the Child Find mandate. Child Find requires all school districts to identify, locate and evaluate all children with disabilities, regardless of the severity of their disabilities.
This obligation to identify all children who may need special education services exists even if the school is not providing special education services to the child.
The IDEA requires all States to develop and implement a practical method of determining which children with disabilities are receiving special education and related services and which children are not. (20 U.S.C. 1412(a)(3); Wrightslaw: Special Education Law, pages 72, 206-207).”
“Schools are required to locate, identify and evaluate all children with disabilities from birth through age 21. The Child Find mandate applies to all children who reside within a State… (20 U.S.C. 1412(a)(3))
This includes all children who are suspected of having a disability, including children who receive passing grades and are “advancing from grade to grade.” (34 CFR 300.111(c)) The law does not require children to be “labeled” or classified by their disability. (20 U.S.C. 1412(a)(3)(B); 34 CFR 300.111(d)).”
And the leverage, as you may have guessed is money. It always comes down to money. Your children are seen as commodities.
On a cute little PDF from the US Department of Education the money incentive is made very clear:
On Slide 3:
The LEA [Local Education Agency] must spend a proportionate share of its federal IDEA funds on services to parentally placed children with disabilities in private schools.
And beyond money, and a man hunt for the disabled, this should send chills through your body:
Due process rights for parents do not apply to services plans.
Asking your neighbors and others in the community to “rat” you out… Sounds like Nazi Germany, not really what people think of when they hear “Dubois, Wyoming”.
When I contacted the Fremont County School District #2 superintendent about this Gestapoesque “Public Notice” (located in the “paid ads” section of the newspaper, not the “public notices” section) she tried to dismiss my concerns by saying “that wasn’t our intent” when I told her she was essentially telling people to rat out their neighbors.
We were off the phone less than a half an hour when she called me back and said “The paper didn’t print that right. Thank you for bringing it to our attention so we can get that fixed”.
I recommended to her that if she puts a revision in the paper, it needs to say ONLY this: “If you have a child with disabilities, the following services are available to you: X, Y, Z, etc…” And nothing more.
I have eyes and ears on the ground in Dubois that will let me know how the revision goes.
And now, a parable warning you about the dangers of busy bodies and the potential damage the ad in the Dubois Frontier could cause families in Dubois.
A busy body in Casper wasn’t even asked to turn people in and she did.
A wonderful grandmotherly woman was the sole teacher at a small church school. She had between 5 & 7 students. Because the school was so small the woman brought her students to participate in homeschool P.E. and to homeschool science, as well as homeschool field trips.
The busy body turned this grandmother in for homeschooling other people’s children! When the church school was adhering to the state law.
And the icing on the cake was when that woman called other homeschoolers she knew that “knew that woman was homeschooling other people’s children and didn’t say anything” to give them a heads up that DFS may be contacting them.
This is a real danger. Fremont County School District #2 poses a real threat to all families of school aged children in Dubois because of this ad in the Dubois Frontier.
We need to be aware of these dangers, but I need your eyes and ears to help me. When you see and hear things in your community that seem to threaten educational and parental rights, please let us know right away.
